In this Privacy Policy, these websites, services, products, communications, and interactions are collectively referred to as the “Services.”

This Privacy Policy applies to personal information controlled by MADC through the Services.

It does not apply to:

  • Employment-related information about MADC employees, contractors, or job applicants, unless otherwise required by law; or

When you follow a link to another website or use a third-party platform, that third party’s privacy practices will apply.

2. Personal Information We Collect

The information we collect depends on how you interact with MADC.

A. Contact and identification information

We may collect:

  • Your name;

  • Email address;

  • Telephone number;

  • Mailing, billing, project, delivery, or property address;

  • Social media handle;

  • Preferred communication method; and

  • Information about your business, employer, or professional role.

B. Client inquiry and consultation information

When you submit an inquiry, questionnaire, consultation request, or discovery-call form, we may collect:

  • The type of design service you are seeking;

  • Your project location;

  • The type, size, age, condition, and approximate value of the property;

  • Whether the property is a primary residence, secondary residence, or investment property;

  • Your desired project scope;

  • Your estimated budget;

  • Your preferred schedule or completion date;

  • Your design preferences, lifestyle needs, and aesthetic interests;

  • How you heard about MADC;

  • Whether you own, lease, manage, or are authorized to make decisions concerning the property; and

  • Any other information you choose to include in your message or questionnaire.

C. Design project information

When you become a client, we may collect and maintain information necessary to plan, manage, document, and complete your project, including:

  • Property addresses and project-site information;

  • Photographs, videos, measurements, surveys, floor plans, elevations, architectural drawings, and renderings;

  • Information about the property’s architecture, condition, construction, furnishings, fixtures, finishes, systems, and layout;

  • Room usage, furniture needs, storage needs, household routines, and design priorities;

  • Information about household members or other individuals who use the space;

  • Material, furniture, art, color, lighting, textile, and finish preferences;

  • Purchase approvals and product selections;

  • Vendor, contractor, trade, receiving, delivery, and installation information;

  • Project schedules, budgets, proposals, invoices, purchase orders, and payment records;

  • Property access instructions, delivery instructions, gate information, or similar logistical details;

  • Communications, meeting notes, feedback, revision requests, and project decisions; and

  • Any other information reasonably necessary to provide the requested design services.

Please avoid submitting alarm codes, safe combinations, permanent access credentials, or other highly sensitive security information through general website forms or ordinary email. When access information is necessary, we may request that it be provided through a more appropriate method.

D. Vendor, contractor, and partner information

If you are a vendor, contractor, trade professional, photographer, artist, installer, receiver, delivery provider, brand representative, or other business contact, we may collect:

  • Your name and business contact information;

  • Company name and professional role;

  • Product, service, pricing, inventory, lead-time, warranty, and trade-program information;

  • Tax, insurance, licensing, certification, and payment information;

  • Proposals, estimates, agreements, invoices, and transaction records;

  • Communications concerning current or prospective projects or partnerships.

E. Transaction and payment information

When you purchase services, products, or materials, we may collect:

  • Limited payment-related information received from a payment processor.

Payment-card and banking information may be collected directly by a third-party payment processor rather than by MADC. We may receive confirmation that a payment was completed, declined, disputed, refunded, or otherwise processed.

We may collect the contents and associated details of communications you send to us, including:

  • Contact-form submissions;

  • Text messages;

  • Voicemails;

  • Telephone-call notes;

  • Social media messages and comments;

  • Consultation and meeting notes;

Where permitted by law, meetings or calls may be recorded with appropriate notice or consent.

MADC does not use sensitive personal information to infer unrelated personal characteristics. We use it only when reasonably necessary to provide the requested Services, protect the parties involved, comply with law, or for another purpose to which you have consented.

Please do not submit medical records, diagnoses, government identification numbers, Social Security numbers, or other unnecessary sensitive information through the website.

This includes evaluating inquiries, scheduling consultations, preparing proposals, developing concepts, creating layouts or renderings, sourcing materials and furnishings, coordinating procurement, communicating with contractors and vendors, managing deliveries and installations, and completing design projects.

We may use information to prepare estimates and invoices, accept and track payments, purchase or return products, coordinate freight and delivery, manage refunds or credits, maintain accounting records, and address payment disputes.

Operate and improve the Services

We seek to limit disclosures to information reasonably necessary for the recipient’s role.

C. Business and brand partners

With your authorization or where otherwise permitted, we may disclose information to brands, collaborators, event partners, referral partners, or sponsors involved in a campaign, collaboration, event, giveaway, or other joint activity.

D. Analytics and advertising providers

We may disclose website and device information to providers that help us understand website usage, measure campaigns, deliver or evaluate advertising, or improve the Services.

Certain disclosures involving cookies or advertising technologies may be treated as a “sale,” “sharing,” or use for “targeted advertising” under some state privacy laws, even when no money is exchanged. Your available choices are described below.

6. Project Photographs, Video, and Portfolio Content

Residential design work may involve photographs, videos, renderings, floor plans, project descriptions, before-and-after imagery, testimonials, or other creative materials.

MADC may use project materials internally as reasonably necessary to:

  • Provide the contracted Services;

  • Present concepts and recommendations;

  • Coordinate contractors, vendors, and installations;

  • Maintain project and business records;

  • Protect MADC’s contractual or intellectual-property rights; and

  • Improve our design process and service offerings.

Any public use of identifiable client-project content—including portfolio publication, website features, press submissions, social media content, advertising, educational content, or brand partnerships—will be handled in accordance with the applicable client agreement, release, authorization, or other documented permission.

Unless separately authorized, MADC will not intentionally publish:

  • A client’s exact residential address;

  • Alarm codes, access credentials, or security-system details;

  • Information that unnecessarily identifies children or other household members;

  • Private financial information; or

  • Other confidential information unrelated to presenting the design work.

Project photography and publicity permissions should also be addressed in the applicable client agreement or a separate media release.

7. Cookies and Similar Technologies

The website may use cookies, pixels, tags, software development kits, local storage, and similar technologies.

These technologies may be used to:

  • Remember preferences;

A browser signal may not apply to information collected outside that browser or device. You may need to submit a separate request to apply your choice more broadly.

MADC does not knowingly sell or share the personal information of individuals under 16 for targeted advertising.

9. Artificial Intelligence and Technology-Assisted Tools

MADC may use technology-assisted or artificial-intelligence-enabled tools to support activities such as:

  • Concept development;

  • Design visualization and rendering;

  • Image refinement;

  • Drafting and documentation;

  • Product research or sourcing;

  • Administrative organization;

  • Communication preparation;

  • Data analysis; and

  • Website or business operations.

When these tools process personal information, we seek to limit the information used to what is reasonably necessary for the relevant purpose and to use available privacy, security, or business-account controls where appropriate.

Client photographs, floor plans, or project materials will not be publicly presented as completed MADC work or published for promotional purposes solely because they were processed through a technology-assisted tool. Public use remains subject to applicable client agreements and permissions.

AI-assisted concepts and renderings may be illustrative and should not be treated as construction documents, engineering plans, or representations of final product availability unless expressly identified as such.

10. Marketing Communications

You may opt out of promotional emails by using the unsubscribe link included in the message or by contacting us.

You may still receive non-promotional communications, such as:

  • Responses to inquiries;

  • Appointment confirmations;

  • Project-related communications;

  • Transactional notices;

  • Purchase or delivery updates;

  • Contractual communications; and

  • Security or legal notices.

Where MADC sends marketing text messages, you may opt out by replying STOP or following the instructions provided in the message. Message and data rates may apply.

11. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide the Services;

  • Complete and document design projects;

  • Maintain client, vendor, transaction, warranty, and procurement records;

  • Fulfill contractual obligations;

  • Comply with legal, tax, insurance, accounting, and regulatory requirements;

  • Protect project history and intellectual-property rights;

  • Maintain security; and

  • Establish, exercise, or defend legal claims.

Retention periods vary depending on the type of information, the relationship involved, applicable contractual requirements, and legal obligations.

When information is no longer reasonably necessary, we may delete it, securely destroy it, anonymize it, or retain it in a deidentified form.

Backup copies may remain for a limited period until they are overwritten or deleted in the ordinary course of system maintenance.

12. Data Security

MADC uses reasonable administrative, technical, and physical measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include:

  • Access controls;

  • Password and account-security practices;

  • Secure or encrypted services where appropriate;

  • Restricted access to project and client materials;

  • Vendor and service-provider review;

  • Secure disposal practices;

  • Software updates and security monitoring; and

  • Internal confidentiality procedures.

No website, electronic transmission, or storage system can be guaranteed to be completely secure. You are responsible for using appropriate caution when transmitting sensitive information and for protecting credentials associated with any account you create.

Texas businesses that maintain sensitive personal information are required to maintain reasonable safeguards and follow applicable breach-notification obligations.

We will not request more information than is reasonably necessary for verification. We may deny a request when we cannot reasonably verify the requester’s identity or authority.

Authorized agents

Where permitted by law, an authorized agent may submit a request on your behalf. We may require evidence of the agent’s authority and may contact you directly to verify the request.

Appeals

If we deny a request and applicable law provides an appeal right, you may appeal by replying to the denial or emailing hello@mckinleyave.com with the subject line “Privacy Appeal.”

Please explain why you believe the decision should be reconsidered. We will review and respond within the period required by applicable law. When required, a denied appeal response will include information about contacting the appropriate regulatory authority.

Nondiscrimination

MADC will not unlawfully discriminate against you because you exercised an applicable privacy right.

14. Children’s Privacy

The website and Services are intended for adults and are not directed to children under 13.

MADC does not knowingly collect personal information directly from children under 13 through the website. If we learn that such information was collected without appropriate parental or guardian authorization, we will take reasonable steps to delete it.

Information about children that is relevant to a residential design project should be provided by the child’s parent, legal guardian, or another properly authorized adult.

15. Information From International Visitors

MADC is based in the United States. If you access the website from another country, your information may be transferred to, stored in, or processed in the United States or another jurisdiction where our service providers operate.

Those jurisdictions may have privacy laws that differ from the laws of your home country. Where required, we will use legally recognized safeguards for applicable international transfers.

17. Do Not Track

Some browsers offer a “Do Not Track” setting. Because there is not a universally adopted standard for interpreting legacy Do Not Track signals, the website may not respond to those signals.

This does not affect our obligation to recognize legally required opt-out preference signals, such as Global Privacy Control, where applicable.

18. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect:
